Terms and Conditions of the Puzzle-Mania Online Shop

1. General provisions and trader information

1. These Terms and Conditions govern the use of the online shop available at www.puzzlemania.eu (the “Shop”), the placing of orders, the conclusion of sales contracts, payment, delivery, withdrawal from a contract and complaints.

2. The Shop is operated by Intranet s.r.o., Čapajevova 8, 040 11 Košice, Slovak Republic, company ID: 46489827, tax ID: 2820015418, VAT ID: SK2820015418, registered in the Commercial Register of the Municipal Court in Košice, Section Sro, Insert No. 29009/V (the “Trader”).

4. These Terms are made available free of charge in a form that allows the customer to save, reproduce and print them. Nothing in these Terms excludes or limits mandatory consumer rights under applicable European Union or national law. If a provision of these Terms conflicts with a mandatory consumer-protection rule, that rule prevails.

2. Definitions

1. Customer means a natural person, legal entity or organisation placing an order in the Shop.

2. Consumer means a natural person acting for purposes outside that person’s trade, business, craft or profession. Where applicable law grants equivalent protection to a natural person acting in business for purposes outside the person’s professional activity, those rights also apply.

3. Goods means the physical products offered in the Shop.

3. Use of the Shop and customer account

1. An account is not required to place an order. The Customer may also order without registration.

2. The Shop requires an Internet-connected device, a current web browser, an active e-mail address and enabled JavaScript and cookies. The Customer must not provide unlawful content, interfere with the operation of the Shop or use it in breach of applicable law or third-party rights.

4. Goods, prices and promotions

1. The Shop provides information about the main characteristics of each Good, including its description, quantity and other relevant product information. Product images are for illustrative purposes; the description and characteristics shown for the specific Good apply.

2. Prices are final prices including VAT and are shown in the currency displayed in the Shop. Delivery charges and any other mandatory charges are shown before the Customer submits the order. The total price is displayed before the order is placed.

3. Where a price is reduced, the Shop displays the lowest price applied to the Good during the 30 days preceding the reduction, where this information is required by applicable law.

4. Promotions are valid for the period stated in the promotion or until stocks run out. Promotions cannot be combined unless the applicable promotion expressly says otherwise.

5. Ordering and conclusion of the sales contract

1. To place an order, the Customer selects Goods, adds them to the basket, enters the data necessary for fulfilment, chooses delivery and payment methods, and checks the order summary.

2. Before submitting the order, the Customer is informed of the main characteristics of the Goods, the total price, delivery charges and any other charges. The order is submitted by clicking a button clearly marked “Order with obligation to pay” or equivalent wording.

3. After an order is submitted, the Trader sends an e-mail confirming receipt. The sales contract is concluded when the Trader sends an e-mail confirming acceptance of the order for fulfilment, unless the Trader informs the Customer that the order cannot be accepted.

4. The contract confirmation is provided on a durable medium and contains the Trader’s details, the Goods ordered, the price, delivery charges, payment and delivery method, and these Terms or a durable link to them. The Customer may request a copy of the order.

5. If the Shop contains an obvious error in the price or product description, the Trader may refuse fulfilment before dispatch and will inform the Customer without undue delay. Any payment already received will be refunded without undue delay.

6. Payment

1. The payment methods and any payment charges available for a particular order are shown during checkout. Depending on the current offer, payment may be made by bank transfer, payment card, an online payment provider, PayPal or cash on delivery.

2. For bank-transfer payments, fulfilment begins after the payment is credited to the Trader’s account. The Trader issues an invoice or other proof of purchase as required by applicable law.

7. Delivery

1. Delivery is available to the countries and by the methods shown during checkout. The available carrier, delivery price and estimated delivery time are displayed before the Customer submits the order.

2. Unless a different delivery period has been agreed, the Trader delivers the Goods without undue delay and no later than 30 days after the contract is concluded. If the Trader fails to deliver within the agreed or statutory period, the Consumer may exercise the remedies provided by applicable law, including setting an additional reasonable period and withdrawing from the contract where permitted.

3. For a Consumer, the risk of accidental loss or damage passes to the Consumer only when the Goods are delivered to the Consumer or to a person designated by the Consumer other than the carrier.

8. Right of withdrawal

1. A Consumer has the right to withdraw from a distance sales contract within 14 days without giving any reason. For a sales contract, the period starts when the Consumer or a person designated by the Consumer, other than the carrier, takes possession of the Goods. If an order is delivered in separate parts, the period starts when the last part is received.

2. To exercise the right of withdrawal, the Consumer must send an unequivocal statement to the Trader by e-mail at puzzlemania@puzzlemania.eu or by post to the address in Section 1. Any clear statement may be used; sending it before the deadline is sufficient to preserve the deadline. Where required by applicable law, the Shop also provides an online withdrawal function that is easy to find and use.

3. After withdrawing, the Consumer must send the Goods back without undue delay and no later than 14 days after notifying the Trader of the withdrawal. The Consumer bears the direct cost of returning the Goods unless the Trader has agreed to bear it or failed to provide the legally required information about that cost.

4. The Trader refunds all payments received, including the cost of the least expensive standard delivery offered by the Trader, without undue delay and no later than 14 days after being informed of the withdrawal. The Trader may withhold the refund until the Goods are received or the Consumer provides proof of return, whichever occurs first. The refund is made using the same payment method, unless the Consumer expressly agrees otherwise.

5. The Consumer is liable only for any diminished value resulting from handling the Goods beyond what is necessary to establish their nature, characteristics and functioning.

6. The right of withdrawal does not apply to the exceptions listed in applicable law, including Goods made to the Consumer’s specifications or clearly personalised Goods, where such Goods are offered by the Shop.

9. Legal guarantee and complaints

1. The Trader is legally responsible for a lack of conformity of the Goods with the contract that exists at the time of delivery and becomes apparent within at least two years from delivery, or for a longer period where required by applicable law.

2. A complaint may be submitted in any form, including by e-mail to puzzlemania@puzzlemania.eu or in writing to the complaints address in Section 1. For efficient handling, the Customer should provide the order number, a description of the lack of conformity, the date it was discovered and the requested remedy. The absence of these details does not remove statutory rights.

3. Depending on applicable law, the Consumer may request repair or replacement of the Goods and, where the statutory conditions are met, a price reduction or termination of the contract. Repair or replacement is carried out free of charge and without significant inconvenience to the Consumer, with the costs borne by the Trader.

4. The Trader responds to a Consumer complaint within the period required by the applicable national law. Where the law provides that failure to respond within a specified period means that the complaint is accepted, that legal consequence applies. If a complaint is accepted, the Trader reimburses the reasonable costs of returning or transporting the Goods as required by law.

5. A manufacturer’s commercial warranty applies only if it has been granted. It is additional to, and does not replace or limit, the Consumer’s statutory legal guarantee rights.

10. Product safety

The Trader places only Goods that comply with applicable EU product-safety requirements on the market. Product listings and packaging contain the manufacturer, identification, safety and responsible-person information required by Regulation (EU) 2023/988, where applicable. Safety questions or reports may be sent to puzzlemania@puzzlemania.eu.

11. Alternative dispute resolution

A Consumer may contact the competent consumer-protection authority, consumer advice service or certified alternative dispute-resolution body in the Consumer’s country of residence. For cross-border purchases within the EU, assistance is also available through the European Consumer Centres Network. Alternative dispute resolution is generally voluntary and does not remove the Consumer’s right to bring proceedings before a competent court. The former EU Online Dispute Resolution platform is no longer available.

12. Personal data

Information about the processing of personal data, the rights of Customers and cookies is provided in the separate Privacy Policy.

13. Intellectual property and user submissions

All content of the Shop, including text, photographs, graphics, logos and software, is owned by the Trader or its licensors and may not be used beyond the scope permitted by law without prior consent. If the Customer sends feedback or other content, the Customer grants only the rights necessary for the Trader to receive, assess and respond to that submission; no transfer of rights is implied beyond that purpose.

14. Liability and severability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for statutory consumer rights, death or personal injury caused by negligence, fraud or intentional misconduct. The Trader is not responsible for a failure caused by circumstances beyond its reasonable control to the extent permitted by applicable law.

If any provision of these Terms is invalid or unenforceable, it will be replaced or limited to the minimum extent necessary, and the remaining provisions will remain effective.

15. Governing law and changes

1. The contract is governed by the law applicable to the contract. A choice of Slovak law, where made, does not deprive a Consumer of the protection provided by mandatory provisions of the law of the country where the Consumer has their habitual residence.

2. Changes to these Terms do not affect contracts concluded before the change. The version effective when the order was placed applies to that order. Updated Terms are published in the Shop and apply to future orders.
